Terms of Sale
  1. Quantities are limited to stock on hand. Wines are sold on a first come first serve basis and after-hour email and phone orders will be taken into account at store opening the next day. Orders must be paid on confirmation of your order. Availability of all products is subject to phone and/or email confirmation. All email offers are valid for one week unless otherwise noted.
  2. Alcoholic beverages may be sold and delivered only to persons who are at least 21 years old. In placing your order, you represent to us that you are at least 21 years old and that the person to whom the wine is sold and/or delivered is at least 21 years of age as of the date of order and sale.
  3. Title and ownership of all wines and other products passes from The Wine Hotel to the purchaser in the state of California and the purchaser takes all responsibility for the shipping of it from The Wine Hotel, 5800 West Third Street, Los Angeles, California to the purchaser’s address. By facilitating transportation of the wine, The Wine Hotel is providing a service to, and acting on behalf of the purchaser. By utilizing this service from The Wine Hotel, the purchaser is representing that they are acting in a fashion compliant with their local and state laws regarding the purchase, transportation, and delivery of wine. The purchaser represents that they have obtained any required permission, paid any required fees or taxes, is working through properly licensed intermediaries where required, is legally entitled to take possession of wine and is legally entitled to take quantities ordered. The Wine Hotel only uses shippers that require the purchaser to provide proof of age at the time of delivery.
  4. All sales are subject to CA sales tax of 9% regardless of destination in the USA or buyer’s legal residence.
  5. The Wine Hotel is not responsible for any breakage or damage of wine sent by common carrier to any party or individual. WE MAKE NO REPRESENTATION TO THE LEGAL RIGHTS OF ANYONE TO SHIP OR IMPORT WINES INTO ANY STATE OUTSIDE CALIFORNIA.
  6. The Wine Hotel prices do not include shipping, handling, insurance or foreign duties.
  7. Futures/pre-arrival wine purchases are not available for immediate pick-up or delivery. We can provide only estimated arrival times for particular wines by phone: 323-937-9463

Returns

We allow products to be returned only if the product is defective. Returns of alcohol products are for store credit only. There is no cash, check or credit card refunds for alcohol under any circumstances.

Billing Information
Orders placed on this website are not final. Your credit card is not charged automatically. A charge is put on your credit card after the product has been packed and the order is deemed complete. Please note that all credit cards are verified. You must provide a billing address that corresponds to the credit card you are using. If the billing address does not match the credit card you will be informed and the order will not be processed until we hear from you.

You acknowledge and agree that The Wine Hotel is not responsible or liable for (1) the availability or accuracy of such web sites or resources; or (2) the content, advertising, or products on or available from such web sites or resources. The inclusion of any link on the Wine Hotel Site does not imply that The Wine Hotel endorses the linked site.

Gift Cards
Gift Cards must be redeemed through The Wine Hotel website or in-person at The Wine Hotel (picture ID required), toward the purchase of in-stock products as displayed on The Wine Hotel website. Gift Cards cannot be used to purchase Gift Cards. Gift Cards are not redeemable for cash and cannot be returned for a cash refund, except to the extent required by law. Any unused balance will be placed in the recipient's gift certificate account and is not transferable. The original expiration date will apply to any unused balance. If your order exceeds the amount of your gift certificate, you must pay for the balance with a credit card. Gift Cards cash value is 1/10 of one cent. Gift Cards and their use on The Wine Hotel website are subject to The Wine Hotel’s general Terms of Service and Privacy Policy. We are not responsible for lost or stolen gift Cards. If you have any questions, please contact us. The Wine Hotel will have the right to close customer accounts and request alternative forms of payment if a fraudulently obtained Gift Card is either redeemed through The Wine Hotel website or is redeemed and used to make purchases on The Wine Hotel website.

No Responsibility to Sell Mispriced Products or Services
The Wine Hotel shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. The Wine Hotel shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, The Wine Hotel shall immediately issue a credit to your credit card account in the amount of the charge.

Protection of Content
All text, graphics, logos, icons, images, audio clips and software on the The Wine Hotel Site ("Site Content") are copyrighted materials owned by or licensed to The Wine Hotel. You may not sell, reproduce, distribute, copy, duplicate, resell, modify, display, publicly perform, prepare derivative works based on, frame, mirror, repost, exploit for any commercial purpose, or otherwise use any of the Site Content in any way for any public or commercial purpose without prior written consent of The Wine Hotel or the rights holder. You may not use the Site Content on any other web site or in a networked computer environment for any purpose. If you violate any of these terms, your permission to use the Site Content will automatically terminate, you must immediately destroy any copies you have made of the Site Content, and we may end your authorization to use the The Wine Hotel Site.

Some things to know as you peruse our website:
  1. A mixed-case discount of 10% will apply to the purchase of 12 or more mixed bottles. This discount does not apply to bottles marked "NO DISCOUNT,” “SALE,” or often “INQUIRE.”
  2. We offer free storage for all the wine you buy from us for up to one year.

  4. We charge California Sales Tax on all wine, beer, cider, and accessories sales without exception. As our client you take full possession of your purchase in the state of California, even if it ultimately is shipped to an out-of-state residence or business. This means that you will be shipping your wine to yourself according to your state’s laws governing shipment of wine. We understand that our practice is not the norm in the retail wine trade, but we believe it is the only responsible position. By example, New York State is a ‘reciprocal’ state, as is California, so it is legal for us to ship wine between the two. The catch-22 even big online wine retailers don’t want you to think about is that New York State requires out-of-state retailers to register with their State Liquor Authority, pay an annual license fee of some $8,000.00, and provide detailed sales reports 18 times per year of all sales shipped into New York State. Recently, New York State sued one of the largest wine internet retailers, The Wine Library of New Jersey, for selling and shipping wine to New York State residents without a license.
  5. We only ship wine within the state of California. We are happy to help you arrange your own shipping by packing your wine in FedEx- and UPS-approved wine shippers (no charge for packaging). You can either email us prepaid shipping labels or simply email us your FedEx or UPS account number and will we affix handwritten labels to your packages. We also request that you inform your shipper of when you want your package(s) picked up at our facility where it will rest in our temperature and humidity controlled warehouse until departure.

Gift Certificates to the Wine Hotel
